Section 1 – Access and Account By agreeing to these GTC you assure that you are of legal age in your country of residence. Certain information may be required to use the Services (e.g. email address, payment and shipping information). You assure that all information is correct, current and complete. You bear sole responsibility for the security of your login data and may not transfer your account to third parties.
Section 2 – Our Products We strive for a correct and realistic presentation of our products. Colors and appearance may vary slightly depending on device, screen and settings. Product descriptions may be adapted if the actual product characteristics change; for already completed orders, the description displayed at the time of your order applies. We reserve the right to discontinue products or limit quantities. Your statutory rights to contractual, defect-free goods remain unaffected by this regulation.
Section 3 – Orders When you place an order, you make an offer to purchase. Magic Paw & Co reserves the right to refuse orders at its own discretion (e.g. in case of suspected fraud, obvious price or description errors or unavailability). An order is considered accepted as soon as Magic Paw & Co confirms acceptance and payment has been processed. Returns and exchanges are subject to our Cancellation Policy and Return Policy. Purchases are intended for personal use and not for commercial resale or export.
Section 4 – Prices and Billing The prices displayed on the website are final prices including statutory VAT. Shipping costs and - for deliveries outside the EU - any customs duties or import charges will be shown separately before completing the order or are to be borne by the recipient in the destination country. Prices may be adjusted up to the time of your order; the price stated in your order confirmation is decisive. You undertake to provide correct and complete payment information and to keep it up to date.
Section 5 – Shipping and Delivery All delivery times are estimates and not guaranteed. We are not liable for delays caused by shipping service providers, customs clearance or events beyond our reasonable control. For consumer orders, the risk of accidental loss only passes upon handover to you – not already upon handover to the shipping service provider.
Section 6 – Intellectual Property All content of the Services – including texts, images, graphics, videos, trademarks and logos – is the property of Magic Paw & Co or its licensors and is protected by EU and international copyright and trademark law. Use of the Services only permits you personal, non-commercial use. Without prior written consent, you may not reproduce, distribute or modify any content.
Section 7 – Optional Tools You may be given access to third-party tools that are beyond our control. These are provided "as is" and "as available". For damages arising from the use of such third-party tools, we are only liable within the scope of Section 16.
Section 8 – Relationship with Shopify Magic Paw & Co is operated on Shopify. All sales are made directly with Magic Paw & Co. Shopify is not a contracting party to your purchase contract.
Section 9 – Privacy Policy All personal data is subject to our Privacy Policy.
Section 10 – Feedback If you voluntarily submit feedback to us, you grant us a perpetual, worldwide, royalty-free license to use this feedback for the operation and improvement of the Services.
Section 11 – Errors, Inaccuracies and Omissions Information on the Services may occasionally contain errors or inaccuracies. We reserve the right to correct them. Should an order have been placed on the basis of an obvious error, we may cancel it within a reasonable period; amounts already paid will be fully refunded.
Section 12 – Prohibited Uses You may only use the Services for lawful purposes. In particular, the following is prohibited: unlawful use, infringement of intellectual property, harassment, transmission of false information, spam, misuse of identity and any use that impairs other users.
Section 13 – Automated Agents No automated software agent may access the Services without identifying itself as such.
Section 14 – Termination We may terminate this agreement or your access to the Services with reasonable notice, and without notice in the case of serious violations. Already concluded purchase contracts and your statutory rights (in particular warranty and withdrawal) remain unaffected.
Section 15 – Warranty For consumers, the statutory warranty rights under the EU Sale of Goods Directive (2019/771) apply in full. If goods delivered are defective upon receipt, you are entitled to subsequent performance, reduction or – under the statutory conditions – withdrawal from the contract, within the statutory periods (regularly two years from receipt of the goods).
Section 16 – Limitation of Liability We have unlimited liability for intent and gross negligence as well as under the Product Liability Act and for damages resulting from injury to life, body or health. In case of slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable, contract-typical damage at the time of conclusion of the contract. Otherwise, liability for slightly negligently caused damages is excluded. Statutory consumer rights remain unaffected.
Section 17 – Indemnification You undertake to indemnify Magic Paw & Co against justified claims of third parties that are demonstrably based on your culpable breach of these GTC.
Section 18 – Severability Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
Section 19 – Waiver; Entire Agreement These GTC together with our Privacy Policy and our Cancellation Policy constitute the entire agreement between you and us.
Section 20 – Assignment You may not assign your rights under these GTC to third parties without our prior consent.
Section 21 – Applicable Law and Jurisdiction These GTC are subject to the law of the Kingdom of Spain, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in an EU Member State, this choice of law does not deprive you of the mandatory consumer protection provisions of your country of residence. For merchants, the place of jurisdiction is Palma de Mallorca, Spain.
Section 22 – Online Dispute Resolution & Consumer Arbitration The European Commission provides a platform for online dispute resolution:https://ec.europa.eu/consumers/odrOur email:support@magicpawco.com We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Section 23 – Changes to the GTC We reserve the right to update these GTC for the future. We will inform you of material changes in an appropriate form before they come into effect. For orders already completed, the version valid at the time of the respective order applies.
